Place: San Francisco Publisher: Towne & Bacon Date: 1867 Description: xlv, [1], 34, [2], 106, 365, [1], 363*-366*, (367)-391 pp. Three lithograph plates including frontispiece, woodcut map and a large folding map backed with linen, formerly tipped-in at rear pastedown, now separate. (8vo) original brown half morocco and marbled boards, gilt-lettered spine. Fourth Edition. Presentation copy, inscribed by the author on the title-page: "Presented to the Library of Rochester University by John W. Dwinelle, June, 1868." Fourth edition. Following the Land Act of 1851, the city of San Francisco, the successor to the pueblo of Yerba Buena, filed a claim for four leagues of pueblo or town lands. The United States contended that the pueblo of San Francisco never existed, which would have invalidated the city's claim for thousands of acres. Dwinelle, the city's special counsel, successfully argued against the federal government in both the district and circuit courts, and in so doing amassed a mountain of documentary evidence on the history of San Francisco during the Spanish and Mexican periods. Cowan notes that most of the documents supporting Dwinelle's argument "are now either inaccessible or destroyed." Additional material was added to each edition as the case moved from trial to appeal. The inserted 34 page section at the front has a separate title page: "Address on the acquisition of California by the United States delivered before the corporate Society of California Pioneers..." (1866). The folding map at the rear is dated 1861 and was produced originally for Langley's San Francisco Directory. Cowan (I), p.75-6; Howes D614; Zamorano 80 #32. Lot Amendments Condition: Lightly rubbed; a few library markings but none terribly offensive; one leaf frayed at margins, folding map newly backed; very good. Item number: 278360
