Terms of Use

The use of LotSearch is free of charge.

Some value-added services with costs are included in "Subscription 
Basic", "Subscription Premium" and the "Day Pass" and can only be used 
after successful registration and payment. Access data may not be 
disclosed to third parties and must be kept safe and inaccessible to 
third parties with due diligence. LotSearch is not liable for the 
improper use of the access data.

The search results or the displayed contents and images are provided by 
the respective auction houses. LotSearch does not guarantee the 
correctness of this information. If the auction houses display objects 
which show signs of National Socialism, this is done exclusively for the 
purpose of civic education, the defense against unconstitutional goals 
and for science and research.

General Terms and Conditions of LotSearch for the fee-based value-added 
services "Subscription Basic" and "Subscription Premium
 

1. Subject of the chargeable value-added services "Subscription Basic" 
   and "Subscription Premium": The online subscriptions entitle the user to 
   use the fee-based value-added services Alerts, Archive and 
   Artists/Analyses. They allow access to the complete online offer of 
   LotSearch via the Internet with a standard software (browser).
    
2. Conclusion of the subscription contract: By ordering an online 
   subscription, a user contract with LotSearch is created. The order is 
   placed by sending the completed online form via the Internet. The access 
   will be activated immediately after the payment has been made. LotSearch 
   is entitled to refuse the subscription without giving reasons.
    
3. Right of use and copyright: With the purchase of the paid value-added 
   services "Subscription Basic" and "Subscription Premium" the users 
   receive the simple, non-transferable right to use the available texts, 
   photos, illustrations, information and data. An acquisition of rights to 
   the texts, photos, illustrations, information and data etc. is not 
   associated with this.
    
4. Terms of payment: For the fee-based value-added services 
   "Subscription Basic" and "Subscription Premium", payment via advance 
   payment, Paypal or Amazon Pay is considered a binding payment condition. 
   The subscription price is based on the currently valid price list. Price 
   changes will be announced one month before they come into effect on the 
   website in the registration area; subscribers will not be notified 
   additionally. Price changes become effective at the beginning of the 
   next agreed payment period.
    
5. Liability: LotSearch endeavors to keep the online offer constantly 
   available. However, no warranty is given for the constant accessibility 
   of the online service.
    
6. Termination of Contract: The paid value-added services "Subscription 
   Basic" and "Subscription Premium" may be terminated with a notice period 
   of ten calendar days at the earliest at the end of the minimum 
   subscription period and thereafter at the end of the respective selected 
   payment period (unless otherwise agreed in writing). Otherwise, the 
   respective subscription is automatically renewed for another year. The 
   cancellation must be sent in writing to the postal address (see imprint) 
   or by email to kuendigung@lotsearch.de.
    
7. Recording of the contract data: The contract data is stored in a data 
   processing system. This is done (in accordance with the legal retention 
   periods) even beyond the date of termination of the contract. They are 
   used exclusively within the framework of the fulfillment of the 
   contract. They will not be passed on to unauthorized third parties.
    
8. Jurisdiction regulation: If LotSearch asserts claims in a judicial 
   dunning procedure, the place of jurisdiction is Stuttgart. The place of 
   jurisdiction for all legal disputes resulting from the subscription 
   contract is the registered office of LotSearch (Stuttgart), provided 
   that the subscriber is a merchant or a legal entity under public law or 
   a special fund under public law.
    
9. Miscellaneous: Should a condition of this contract be or become 
   ineffective, the rest of the contract shall remain effective. The 
   parties agree already now to replace the invalid provision by a valid 
   provision that comes as close as possible to the economic sense of the 
   replaced provision.
