VIRGINIA CHARTER.[CHARLES II, KING OF ENGLAND. 1630-1685.] Manuscript document on paper, being a contemporary official attested copy of the Charles II's new Charter of the Colony of Virginia, 3 pp, folio (302 x 190 mm), Westminster, October 10 [1676], fold creases, a few ink smudges (contemporary), light soiling to edges.
Provenance: Papers of Sir Edmund Andros (bookseller's description from H.P. Kraus).
AN IMPORTANT DOCUMENT IN EARLY VIRGINIA AND AMERICAN HISTORY, AN OFFICIAL COPY OF THE NEW CHARTER OF VIRGINIA. Charles II initially approved a more generous charter in 1675, at the request of Governor Berkeley, who expressed concern at the private charters being issued throughout the colony. However, likely in response to Bacon's Rebellion in early 1676, Charles II revised his new charter. Still, the document guaranteed rights that became an important step in the development of English and Colonial law. The new charter specifies that all settlers "shall owe obedience to the Governor as they to the King," as opposed to private patentees, and that the Governors of Virginia should reside there during their terms of office. It confirms all prior grants of land and promotes immigration stipulating that each new settler of the territory should receive a grant of fifty acres of land. And finally, the charter reserved to the Governor and Council "full power and authority to hear and determine all treasons, murders, felonys and other offences" according to the laws of England.
